PAIA & Access to Information
Information for requesting records from INFOLED under the Promotion of Access to Information Act 2 of 2000, as amended.

1. Purpose
PAIA gives access to records held by a private body where the record is required for the exercise or protection of a right, the procedural requirements are met, and no lawful ground for refusal applies. This page explains INFOLED's record categories and how a request may be made. It should be read with PAIA, its regulations, and the Information Regulator's official guide.

3. The Information Regulator's PAIA Guide
The Information Regulator publishes a guide explaining PAIA and POPIA, the forms and procedures for access, available assistance, fees and legal remedies. It is available in South Africa's official languages and may be obtained from the Regulator or requested from INFOLED.
4. Records available without a formal request
The following public records may generally be viewed on this website without submitting Form 2:
- general company contact information and service descriptions;
- published project information, articles and marketing material;
- the Privacy Policy, Cookie Policy, Website Terms, Terms of Sale and Service Level Agreement;
- this PAIA information and request procedure.
Other records may be provided informally where appropriate, but INFOLED may require a formal PAIA request depending on the record, requester, confidentiality and applicable rights.
5. Records held under other legislation
Where applicable to INFOLED's operations and the relevant entity, records may be maintained under legislation including:
- Companies Act 71 of 2008;
- Income Tax Act 58 of 1962 and Value-Added Tax Act 89 of 1991;
- Basic Conditions of Employment Act 75 of 1997, Labour Relations Act 66 of 1995, Employment Equity Act 55 of 1998 and Occupational Health and Safety Act 85 of 1993;
- Consumer Protection Act 68 of 2008 and Electronic Communications and Transactions Act 25 of 2002;
- Protection of Personal Information Act 4 of 2013; and
- Promotion of Access to Information Act 2 of 2000.
Listing legislation does not mean every record is automatically available. Access remains subject to PAIA and other applicable law.

7. Processing of personal information
INFOLED processes personal information for customer service, quotations and contracting, project delivery, monitoring and maintenance, supplier and workforce administration, finance, legal compliance, safety, security, marketing where lawful, and the establishment or defence of legal rights.
Data subjects may include prospects, customers, customer personnel, suppliers, contractors, employees, applicants, website visitors, professional advisers and other business contacts. Information may be supplied where necessary to service providers, funders, insurers, professional advisers, project participants, equipment or warranty providers, and lawful authorities. 8. Security measures
INFOLED uses reasonable technical and organisational measures appropriate to the nature of the information, including access control, authentication, system and hosting safeguards, backups, supplier controls, staff measures and secure disposal practices. Controls are reviewed as operations and risks change.
9. How to request access
- Download and complete the prescribed Form 2: Request for Access to Record from the Information Regulator's PAIA page.
- Describe the requested record clearly enough for it to be identified.
- Identify the right you seek to exercise or protect and explain why the record is required for that purpose.
- State the preferred form of access and provide contact details.
- Attach proof of identity and, if acting for another person, proof of authority. Mask information that is not reasonably needed.
- Send the request to info@infoled.co.za or deliver it to the physical address above.
Prescribed request and access fees may apply. INFOLED will notify you where a fee is payable. A request may be granted, partially granted or refused on a ground permitted by PAIA, including protection of privacy, confidential commercial information, safety, legal privilege and certain third-party rights.
10. Decisions, complaints and remedies
INFOLED will respond within the period prescribed by PAIA, subject to any lawful extension. If access is refused or no response is received, a requester may complain to the Information Regulator after giving INFOLED an appropriate opportunity to resolve the request, or seek relief from a competent court as permitted by law.
